Excellent article, Branden! I just discovered your blog and will definitely be a regular visitor.

You really can't overstate Cain's duplicity and stupidity. The scary thing is, this clown knows all the right buzzwords that resonate with Amerika's witless, economically ignorant sheeple, so the odds of him emerging as the G[ang]O[f]P[lunderers] candidate in next year's election are very great. He's also sunk to another new low in pandering to the law-and-order, immigrants-are-the-scourge-of-the-nation crowd by chumming it up with "America's Greatest Fascist, er, Sheriff," Joe Arpaio (or, as we liberty lovers here in the Grand Scamyon State call him, "Joke Arpiggo").

Let us hope that Cain simply implodes under the weight of his own stupidity and lies, but I'm not optimistic that there's that much justice in our world.

Thank you again Zach. In response, I refer to <a href="http://www.brandenespinoza.com/site/bookreviews/bastiat-frederic-the-law/ rel="nofollow">Bastiat:

Men naturally rebel against the injustice of which they are victims. Thus, when plunder is organized by law for the profit of those who make the law, all the plundered classes try somehow to enter—by peaceful or revolutionary means—into the making of laws. According to their degree of enlightenment, these plundered classes may propose one of two entirely different purposes when they attempt to attain political power: Either they may wish to stop lawful plunder, or they may wish to share in it.

Now given that Romney is on the record confirming the premise for a cap an trade structure, we must ask, is he hoping to stop lawful plunder, or to share in it? Sadly, and this is coming from a BYU grad/former Romneyite, the tea leaves tell me it's the latter.

Zach, thanks for commenting and making me think a little bit. You are 100% correct, dumping every single case on the judiciary is far from a solution independent of government.

I've given it some more thought and still stand behind my suggestion. Given that roughly 98% of all civil suits are settled before ever going trial, saying that this is "dumping" the problem on the judiciary is hardly accurate. Rather, it provides guilty parties opportunities to make amends with injured parties without ever stressing the judiciary.

Now, you mention the threat of legislative statute and punitive damages. That is so very frustrating to me. The idea of punitive damages is morally abhorrent to someone who believes in justice. In what world is it just to require someone to pay greater restitution than the actual value of the damages they caused? So long as it is the injured party that brings suit, and not the state itself, then business retains some check against judicial over reach.

Finally, if mediation were to become the norm in climate change suits, then the majority of suits brought to trial would carry a heavier presumption of innocence on the part of the accused.

More than anything, this approach would, in the broad spectrum, place not business on trial, but science.

I think those of us who subscribe to a libertarian line of thinking sometimes o think that ALL those who subscribe to higher levels of governmental intervention are somehow "power hungry." That may be correct in some cases. I don't necessarily think that is the case with Romney in this situation.

Compensatory or punitive damages are awarded based upon breach of duty. This is usually based on legislative statute. If you want the government to stay out of the business of climate change, then that must include the judiciary.

Climate change may or may not be transpiring. It may or may not be aided by human consumption and use of fossil fuels. That argument is for another day. But the answer to the problem Isn't dumping the judiciary with any and all claims of merit. That may be as dangerous and costly to business than any governmental (see executive or legislative) intrusion.

It isn't that Romney has changed. He hasn't. He's the same old political opportunist he has always been. It is that there has been a shift in understanding among so many of us conservative and libertarian activists. We've spent the last 3 years witnessing big businesses cozy up to government. We've seen investment banks swindle the taxpayer out of trillions by cutting deals with Washington. Capitalism has gotten raped by corporatism. We have seen TSA thugs touching women's private parts. We have seen wars started by presidents without a declaration from Congress.

Romney is a corporatist, not a capitalist. He is comfortable with heavy handed government because his days at Baine Capital taught him how to maneuver through Washington to get exceptions to bad law. He is OK with big government. He also believes that America should maintain her empire throughout the entire world. He is comfortable with the fact that we have 900 military bases in over 120 different countries. In fact he wants to expand that. Finally, he understands that a fearful citizenry is a dependent one. He is comfortable with telling us that if we don't kill brown people in the middle east, they will kill us because of our freedom and love of liberty. In fact, he has said as much.

Many of us political activists that believe in the power of freedom are exhausted. We are tired of the backroom corporatist deals that only big businesses get (in order to crush their small business competitors). We are tired of borrowing money from China to pay for our empire. Why are we paying for Europe's defenses? Why are we policing the world? This isn't about religion. This is about a fundamental understanding of the role of government.

For too long we have allowed ourselves to be told that government's job is to protect us. Many of us, especially latter-day saints with our rich history of Civil Disobedience to an oppressive government, have awaken to the notion that that is NOT the role of gov't. Her only purpose is to protect our liberty. That is it. She has been failing. Romney is caught in the old paradigm, but what you have been seeing, in so many of us turning away from the Romney's of the world, is that there is a new paradigm with an old refrain: DON"T TREAD ON ME. LIBERTY OR DEATH.
